SSC 2016 case: Notification Regarding Return to Previous Workplace as per Supreme Court Verdict

SSC 2016 case: The Directorate of School Education, Government of West Bengal, issued an important notification on June 20, 2025. This notification is based on the Supreme Court’s judgment dated April 3, 2025, primarily related to the SSC 2016 case. This notice provides guidelines for all those candidates who are not categorized as “tainted” and wish to return to their previous workplaces.
Application Process
All candidates who are not “tainted” can apply to return to their former workplaces. Many have already submitted their applications to the Directorate of School Education and the DI Secondary. The Directorate has compiled a list of applications submitted directly to them and has forwarded it to the DI Secondary.
Verification Process
The entire responsibility for verification has been entrusted to the DI Secondary. They will also verify the applications received directly by them. The following points will be scrutinized for verification:
- Whether the candidate was appointed under SLST 2016 or 3rd RLST 2016.
- Whether the candidate is “tainted” or accused.
- Whether the candidate was in approved service as of April 2, 2025 (the day before the judgment).
Candidates must submit necessary supporting documents during the verification.
Reporting and Format ‘A’
The DI Secondary must submit a report to the Directorate within three days, following a specific “Format A,” along with all supporting documents. This format must include the following information:
- Serial number
- Candidate’s name and designation (e.g., Assistant Teacher, Clerk, Group D)
- IOSMS Employee ID
- Confirmation that the candidate is not “tainted” (Yes/No)
- West Bengal School Service Commission’s recommendation memo number and date
- DI approval memo number and date (including information if transferred)
- Name of the school and district where the candidate was working on April 2, 2025
- Confirmation of attachment of the last month’s system-generated pay slip
- Details of previous service, including the name of the department the candidate wishes to return to
- Designation and address of the appointing authority of the previous workplace
- Name of the post/designation in the previous service
This notification is extremely important for all candidates who wish to return to their previous workplaces. They should read these guidelines carefully and act accordingly.
