Breaking News! West Bengal State Files Modification Application in Supreme Court in DA Case

DA Case: The West Bengal government has filed a fresh application in the Supreme Court regarding the payment of Dearness Allowance (DA) to state government employees. The state government has sought another six months to formulate the rules for paying the DA. This application is not for seeking an extension to pay the DA itself, but to finalize the rules and principles for its payment.

Background of the Application

On May 16, 2025, the Supreme Court had directed the state government to pay 25% of the outstanding DA. Following this order, the state government has filed this new application. The state government’s argument is that the State Administrative Tribunal (SAT) had earlier asked for the formulation of rules for DA payment, and this additional time is required to finalize those rules.

Key Points of the Application

  • Time for formulating rules: Six months’ time has been sought to create a specific set of rules or principles on how the DA will be paid.
  • Not a deadline extension for payment: This application has not been made to extend the deadline for paying the outstanding DA.
  • Compliance with SAT’s directive: The state government states that it wants to formulate these rules in compliance with the SAT’s directive.

Next Step in the Case

The next hearing in this case is scheduled for August 4. This application for modification and extension by the state government was filed on June 27. Now, it remains to be seen whether the Supreme Court responds to this plea from the state government. If the court grants this application, the process of receiving DA could be further delayed.

This development has sparked fresh discussions among state government employees. They have been waiting for the DA for a long time and are looking forward to the outcome of this case. Now, their future depends on the Supreme Court’s verdict. While the state government is talking about formulating rules, the employees want their outstanding DA to be cleared quickly.
