TET 2022 Case: The legal battle regarding wrong questions and answers in the Primary TET 2022 examination has taken a new turn. A fresh chapter has been added to this ongoing saga as candidates have filed a new writ petition in the Calcutta High Court, challenging the report submitted by the Expert Committee to the Single Bench. The most significant aspect of this new case is that the Expert Committee itself has been directly included as a party (respondent).
Background of the Case
Following the TET 2022 examination, there was widespread dissatisfaction among candidates regarding answers to several questions and printing errors in the question paper. Consequently, the court directed the formation of an Expert Committee to verify the validity of these questions. However, the report submitted by the committee after a long wait of 15 months has not been accepted by a section of the candidates. They allege that the report is flawed and biased, leading them to knock on the doors of the court once again.
Major Allegations Against the Expert Report
In the writ petition, candidates have raised several serious allegations against the Expert Committee’s report:
- Delay and Unsatisfactory Outcome: Despite taking 15 months, the report submitted is incomplete and fails to address the core demands of the candidates.
- Ignoring Multiple Answers: For questions where multiple answers could be correct or where the question itself was erroneous, the report allegedly failed to provide a proper solution or explanation.
- No Relief for Printing Errors: Candidates were given no relief regarding printing errors in the question paper, which has been a major point of contention.
- Lack of Professionalism: Handwritten notes and overwriting were observed within the typed report. Such anomalies in an official document have raised questions regarding its transparency and professionalism.
Violation of Natural Justice
The petitioners argue that the principles of Natural Justice were violated. They claim that when the report was submitted to the Single Bench, they were not given any opportunity to scrutinize it or present their counter-arguments. A verdict was delivered without affording them a chance to examine the report, which they believe is contrary to fair legal proceedings.
