DA Case Update: Supreme Court Changes Judge in DA Case Again, Check Serial Number and Time

DA Case Update: The wait for the state’s government employees regarding the DA case is about to end. The hearing for this case is scheduled to take place in the Supreme Court on August 4, 2025. Millions of government employees, teachers, and pensioners in the state are looking forward to this hearing. In today’s post, we will discuss the details of this case extensively.

Formation of the New Bench and Its Significance

A new bench has been formed in the Supreme Court for the hearing of this case. While Justice Sanjay Karol remains on this bench, Justice Prashant Kumar Mishra has replaced Justice Sandeep Mehta as the new judge. It is noteworthy that Justice Prashant Kumar Mishra has previously participated in two hearings of this DA case.

He had heard this case along with Justice Hrishikesh Roy in February-March 2024. Therefore, his inclusion in this case has added a new dimension.

The serial number of this case is 13, which is among the first to be heard.

Along with this, the hearing will also be held based on the contempt of court case and the state’s miscellaneous or modification application.

Case Background

For a long time, the state’s government employees have been protesting to receive Dearness Allowance (DA) at the central rate.

The Calcutta High Court had ruled in favor of the state employees and ordered the payment of DA at the central rate. However, the state government challenged this verdict in the Supreme Court. Since then, the case has been pending in the apex court.

The Supreme Court, in its interim order, had mentioned clearing 25 percent of the arrears.

The organizations of the state government employees are continuously carrying on their protest. Their demand is that DA according to AICPI is their rightful claim, and the state government is depriving them of that right.

On the other hand, the state government’s stance is that it is not possible to provide DA at the central rate due to their financial constraints.

Potential Outcome of the Upcoming Hearing

The hearing on August 4th is going to be extremely important.

The following issues may be highlighted in this hearing:

  • Contempt of Court Case: The hearing on the contempt of court case filed because the state government did not comply with the High Court’s order may take place.
  • State’s Application: There may be a discussion on the modification application filed by the state government.
  • Demand of the Sangrami Joutha Mancha: The demands presented by the Sangrami Joutha Mancha may also be heard and included in the case.

It will become clear after this hearing when the state’s government employees will receive Dearness Allowance at the central rate. However, the reappointment of Justice Prashant Kumar Mishra to this case is being seen as a positive sign by the protestors.

Since he is already familiar with the case, it is hoped that he will delve deep into the matter and deliver a just verdict. The future of millions of government employees in the state depends on the outcome of this case. Therefore, the entire state is looking forward to August 4th.
