High Court Benches: A major shuffle has been announced regarding the benches at the Calcutta High Court designated to hear education-related cases. This change affects crucial matters concerning Madrasa, Primary, Upper Primary, and SSC cases, and is widely expected to alter the pace and direction of these long-pending proceedings. New Division Bench for Education Matters

A new Division Bench, designated as Group 2, has been formed to hear all education-related matters. This includes cases related to Primary, SSC, Madrasa, and colleges. The bench will comprise the Hon’ble Justice Tapabrata Chakraborty and the Hon’ble Justice Partha Sarathi Chatterjee. Notably, Justice Partha Sarathi Chatterjee has previously worked alongside Justice Tapabrata Chakraborty on other cases. This bench is known for its practice of thoroughly hearing all sides before delivering well-considered orders, which is expected to aid in the fair resolution of these cases.

Significant Changes in Single Benches

In addition to the division bench, significant changes have also been implemented in the Single Benches that handle specific education dockets.

SSC Matters

All matters related to the SSC (Secondary, Higher Secondary, Group 2) have now been assigned to the bench of the Hon’ble Justice Amrita Sinha. This move is being viewed as a positive development for the petitioners. Justice Sinha is noted for delivering judgments in favour of deprived candidates and has a history of issuing significant directives in complex cases.

Primary Matters

Primary education cases, which had reportedly stalled with little to no progress, have been reassigned. Previously, these cases were heard by multiple benches. The most recent bench, under Justice Rajarshi Bharadwaj, was primarily handling contempt, pension, and transfer-related matters rather than focusing on new recruitment or panel issues.

The primary education docket has now been assigned to the Hon’ble Justice Bibhas Pattanayak. This bench will take up cases related to Primary Education, Para Teachers, Madrasa, and Secondary Education Centers (MSK/SSK). This change is also seen as a positive step, as Justice Pattanayak is expected to advance these stalled cases and bring new momentum.
