Primary Teacher Recruitment: The Fight for DELED Candidates’ Appointment, A New Turn in the Contempt of Court Case

Primary Teacher Recruitment: The case regarding the recruitment of DELED (Diploma in Elementary Education) candidates from the 2020-2022 batch against the West Bengal Board of Primary Education (WBBPE) has taken a new turn. Due to the board’s inaction despite repeated legal notices, the candidates have finally filed a contempt of court case in the Supreme Court. In this blog post, we will discuss the details of this case and its potential outcomes for the candidates.
Key Developments
For a long time, the DELED candidates of the 2020-2022 batch have been waiting for their recruitment. They claim that they are eligible for appointment according to a Supreme Court order. However, the situation has become more complicated as the West Bengal Board of Primary Education has not taken any steps in this matter.
Repeated Notices and the Board’s Silence
The candidates have sent a total of five notices to the board through their lawyers. The purpose of each notice was to include the candidates in the recruitment process in compliance with the Supreme Court’s order. But there was no positive response from the board.
- First Notice: April 9, 2025 – A request to comply with the Supreme Court’s order of April 4.
- Second Notice: May 5, 2025 – A renewed request to allow candidates to participate in the recruitment process.
- Third Notice: June 23, 2025 – The board was asked to consider the appointment of the petitioners within seven days.
- Fourth Notice: July 15, 2025 – This notice explicitly stated that failure to comply would lead to contempt of court proceedings, including imprisonment.
- Fifth Notice: July 30, 2025 – A final three-day period was given to the board to take action.
Contempt of Court Case
As sending repeated notices yielded no results, the candidates filed three separate contempt of court cases in the Supreme Court. This step has added a new dimension to their fight and has increased the pressure on the board.
A New Turn in the Case
Meanwhile, the board has filed a Miscellaneous Application (MA) in the Supreme Court for clarification regarding the vacant positions. Most importantly, all three contempt of court cases filed by the candidates have been tagged with this main application. This means that all the cases will be heard together. According to legal experts, this is an advantageous situation for the candidates as it will strengthen their case and all related matters will be considered simultaneously.
Future Prospects
At this moment, all the DELED candidates are hopeful. Since all the cases will be heard together, it is expected that a positive and comprehensive solution will emerge. All eligible candidates, including the petitioners who participated in the interview process, are waiting for good news. The final outcome of this legal battle now depends on the verdict of the Supreme Court, which will determine the future of thousands of job aspirants in West Bengal.
