DA Update: Warning of Supreme Court Action Amidst State Government’s Inaction on DA

DA Update: Malay Mukhopadhyay, the General Secretary of the Confederation of State Government Employees, has strongly criticized the state government’s stance on Dearness Allowance (DA) for state government employees. In an interview, he stated that if the state government fails to release the DA within a specific deadline, they will be compelled to take legal action. His statement has brought a new wave of hope among the state government employees.
Ultimatum Given to the State Government
Malay Mukhopadhyay has clearly stated that they will wait until the 27th of July. According to him, with the Rath Yatra holiday included, the state government has only 5-6 days to act. If the government does not take any positive steps regarding the DA payment within this period, they will be forced to take the next step.
Preparations for a Legal Battle
Mukhopadhyay also outlined the steps the Confederation will take if the government remains inactive.
- Issuing a Notice: First, a notice will be served to the state’s Chief Secretary and Finance Secretary. After issuing the notice, they will wait for at least seven days to give the government an opportunity to clear the DA dues.
- Supreme Court Petition: If the state government still fails to act, they will file a contempt of court petition in the Supreme Court.
Trust in the Supreme Court
Malay Mukhopadhyay mentioned that the next hearing for the case is scheduled for August 4th. However, they are trying to get the hearing date expedited. For this, a “mention hearing” will be requested through their Supreme Court lawyer. He said, “We cannot snatch the DA from the government. We have complete faith in the Supreme Court’s verdict. If the state government does not comply with the highest court’s directive, the court itself will take the necessary action.”
He further added that the Confederation has maintained from the beginning that they will accept the court’s decision. The right to receive DA twice a year based on the All India Consumer Price Index has already been acknowledged by the court.
Overall, the fight for DA for state government employees has taken a new turn. This firm stance and the decision to pursue legal action by the Confederation are expected to increase pressure on the state government. It now remains to be seen whether the government will act within this deadline or if the matter will once again be escalated to the court.
