The primary reason for this case is the state government’s failure to comply with the Supreme Court’s directive. A contempt of court charge has been brought because the state government did not pay the DA despite the Supreme Court’s order. Advocate Firdous Samim stated that a contempt notice was initially served to the Chief Secretary and Finance Secretary, but when no response was received, the case was finally filed. The case number is 35252/2025.
Current Status and Strategy of the Case
Advocate Firdous Samim mentioned that an attempt will be made to mention the case in Justice Carl’s bench, as he had delivered the original verdict. The goal is to have the case heard before August 4th, which is the next scheduled hearing date in Justice Carl’s bench.
The state government has filed a modification application, seeking to change its stance. However, according to Firdous Samim, this application is not acceptable as it contains self-contradictory statements. He believes this application will only increase the state government’s troubles. Their legal team is well-prepared to counter every point raised in the modification application.
Arguments Against the State Government
Advocate Firdous Samim strongly criticized the state government’s dual policy. He said that on one hand, the government claims it lacks sufficient funds to pay the employees’ outstanding DA, while on the other hand, it is spending lavishly on various festivals and events. These two things cannot coexist. It is not reasonable to spend huge amounts on festivities while depriving employees of their rightful dues.
The Plight of Pensioners
The plight of pensioners has been particularly highlighted in this case. Pensioners in West Bengal already receive low pensions. On top of that, the prices of essential commodities and medicines are continuously rising. In this situation, not receiving Dearness Relief (DR) has made their survival extremely difficult. Both current employees and pensioners are severely affected by the non-payment of DA and DR.
