Did the State Government Tamper with the 6th Pay Commission Report? Shocking Claims by Lawyer

6th Pay Commission Report: Following a landmark verdict by the Calcutta High Court, the long-awaited recommendations of the Sixth Pay Commission are finally public. According to lawyer Probir Chatterjee, this revelation is set to give the Dearness Allowance (DA) case a new direction. Let’s delve into the details of this case.

Background of the Case

The case began when Debaprasad Babu sought a copy of the Sixth Pay Commission’s recommendations under the Right to Information (RTI) Act but was denied. He then approached the High Court, and the case was heard in the court of Justice Amrita Sinha. The court directed the state government to immediately upload the commission’s recommendations to their website.

Government’s Delay and Court’s Intervention

Initially, the document uploaded by the state government to its website was missing several crucial pages. Specifically, pages 101 and 142 were not found. Additionally, pages 13.5 and 13.6, which reportedly contained details about various allowances, were also missing. Although the state government initially claimed the document could not be made public, it was forced to upload it after the court’s order, making its apprehension clear.

Justice Amrita Sinha ordered the immediate provision of the missing pages. Subsequently, page 101 was provided, but page 142 is still missing. The court has ordered the government to provide a printout of the missing page or upload it to the website within a week.

Impact on the DA Case

According to lawyer Probir Chatterjee, this 800-page recommendation could be extremely significant for the DA case. He believes that the document may contain certain ‘fallacies’ that could strengthen the claims of the state government employees in the DA case. The government’s reluctance to publish this document suggests it might contain information that could go against them.

Questions About the Document’s Authenticity

Many have expressed suspicion that the government may have edited the document before uploading it to the website. Justice Amrita Sinha has stated that if any such ‘fallacy’ or evidence of editing is found, the petitioners can file a new writ petition. Probir Babu has stated that if any proof of document tampering is found, he will present it to the Supreme Court.

The Role of the Unity Forum

Probir Babu praised the role of the Unity Forum, especially Debaprasad Halder. It was their legal battle that brought these recommendations to light. He emphasized that the document was released solely due to their legal efforts.

The Importance of Legal Action

Probir Babu once again highlighted the importance of legal action. The government was compelled to release this document only because of the court’s order, which proves the effectiveness of the legal fight. He concluded by saying that the court’s directive is paramount and can be far more effective than any other form of protest.
