WB DA Arrears Update Confederation Sends Contempt Notice to State Officials

DA Arrears Update: The battle for Dearness Allowance (DA) for West Bengal state government employees has taken a critical turn following non-compliance with the Supreme Court’s directives. The Confederation of State Government Employees, led by General Secretary Malay Mukherjee, has initiated stringent legal action against the state’s top bureaucrats for failing to adhere to the apex court’s recent order.

Contempt Notice Served to Top Officials

On February 5th, the Supreme Court of India delivered a significant verdict directing the state government to clear 25% of the DA arrears with “Immediate Effect.” According to Mr. Mukherjee, the Confederation acted swiftly, submitting a copy of the judgment to the offices of the Chief Secretary and the Finance Secretary on the very same afternoon to ensure prompt execution.

However, despite the clear directive, the state government failed to disburse the payment. Following due process, the Confederation waited for seven days. With no action taken by the administration, on the eighth day, they formally issued a Contempt of Court Notice to both the Chief Secretary and the Finance Secretary regarding the non-compliance with the Supreme Court’s order.

Strict Stance on the High Power Committee

The Supreme Court had also instituted a High Power Committee to resolve the dispute. Clarifying the Confederation’s stand on this committee’s operations, Malay Mukherjee outlined a non-negotiable condition:

  • Pre-condition for Dialogue: The committee will not engage in any discussions regarding the remaining 75% of the arrears until the government complies with the initial order to pay the 25% DA.
  • Government’s Obligation: Regardless of any parallel committees the state might wish to form, their primary and immediate legal obligation is to honor the Supreme Court’s mandate regarding the initial payment.

Assurance to Employees

In light of these developments, Malay Mukherjee has sent a strong message of reassurance to all state government employees, teachers, and pensioners. He affirmed that the organization remains steadfast in its mission to secure the rightful dues of the employees. He also extended his gratitude to Advocate Firdous Shamim and other legal aides for their continuous support in this legal battle. The Confederation has made it clear that the fight will continue until the employees receive their entitled benefits.
