DA Case Update: Today, August 18, 2026, marks an extremely important day for lakhs of West Bengal government employees, teachers, and pensioners. The long-awaited Dearness Allowance (DA) arrears case comes up today at 2 PM before the Special Bench of Justice Sanjay Karol and Justice Prashant Kumar Mishra in Courtroom Number 8 of the Supreme Court. Bhaskar Ghosh, convenor of Sangrami Joutha Mancha, has himself announced on social media that internationally acclaimed senior advocate and former Solicitor General of India, Mr. Gopal Subramanium, will be present in court to argue on behalf of the employees.

The case, State of West Bengal versus Confederation of State Government Employees, is listed today as a “Fixed Matter” (Part-Heard). Several connected contempt petitions are attached to it as well; petitions filed by the Confederation of State Government Employees, the Sarkari Karmachari Parishad, the Sangrami Joutha Mancha, and the Unity Forum are all scheduled to be heard alongside the main matter. If time remains in the list after the main case concludes, other matters from the regular cause list may also be taken up. Two days before the hearing, at 6 PM on August 16, advocate Gopal Subramanium held a conference with Sangrami Joutha Mancha on the DA case. Speaking on the occasion, Bhaskar Ghosh said that Sangrami Joutha Mancha is making its maximum effort, both inside and outside the courtroom, to resolve the complications standing in the way of implementing the Supreme Court’s verdict. He made clear that while efforts to reach a solution through talks with the government are underway on one hand, the fight to recover the ROPA-2009 arrears as per the court’s directions is being pursued with equal vigour on the other. In his words, “There is no conflict between the two. In the end, victory will belong to the employees and teachers.”
Background of the Case
The case also involves a Monitoring Committee headed by retired Justice Indu Malhotra, whose report is expected to form the basis of today’s discussion. A portion of the arrear DA has already begun reaching the accounts of government employees and pensioners in phases; however, grant-in-aid employees, including teachers, along with many pensioners in the Kolkata Municipal Corporation area, are still awaiting that money. Adding to the significance of the moment, one of the judges associated with this case is reportedly set to retire this very month, which has made today’s hearing even more consequential.
For several years now, West Bengal’s state government employees, teachers, and education workers have been sustaining a continuous movement demanding their rightful DA arrears. From street protests to hunger strikes and a long-drawn legal battle, their voice of protest has never faded at any point. After the Calcutta High Court ruled in favour of the employees, the state government approached the Supreme Court. Since then, the hearing date has been repeatedly postponed, prolonging the wait. But today’s hearing before this Special Bench is a major ray of hope for them. The joint forum has expressed firm conviction that the final push in this legal battle is being made and that, in the end, victory will belong to the employees and teachers.
